Terms Of Use

By using the WAX web site (the "Site"), you agree to the following Terms of Use:

  1. The Site and its content are being made available for the purpose of private study, scholarship and research. The Site and its content are protected by copyright, trademark and other laws, and also may be subject to other legal interests.
  2. You agree to use the Site's content only in ways that comply with copyright and all other applicable laws and that do not infringe or violate anyone's rights. If you wish to copy, distribute, display or make any other use of the Site's archived content, beyond any use allowed under fair use or other statutory copyright exemptions, you agree to obtain permission from the copyright holder. You also agree to obtain any necessary permissions from the holders of other rights (such as, for example, trademarks or rights of publicity). You are responsible for determining whether permission is needed to make any use of the Site's content that you wish to make, and for obtaining all necessary permissions. You should consult the web sites that have been archived for information about rights, contacts, and permissions.
  3. Original content on the Site created by WAX personnel and Harvard collections managers--including design of the WAX site and descriptions of and annotations to the collections--is owned by Harvard University. You may use that content for individual research or teaching, or as otherwise allowed under fair use or other statutory copyright exemptions. For any other use (including, without limitation, any commercial use), you must obtain Harvard's permission, and should contact http://nrs.harvard.edu/urn-3:hul.ois:waxpublichelp for that purpose or for other inquiries about WAX and its activities.
  4. Harvard makes the Site and its content available free of charge and disclaims all warranties of any kind (express, implied, or otherwise) regarding the Site and its content. Your use of the Site and its content is at your own sole risk. In no event shall Harvard be liable to you--in contract, tort (including negligence), or otherwise--for any consequential, special, general, incidental, direct, indirect or other damages of any kind arising out of your use of the Site or any of its content. You agree to indemnify and hold harmless Harvard from and against any and all claims, actions, damages, losses, liability, costs and expenses (including attorneys' fees) arising from your use of the Site or any of its content. As used in this paragraph, the term "Harvard" includes Harvard University and it affiliates, governing board members, officers, employees, and agents.
  5. Harvard reserves the right to change these Terms of Use from time to time. These Terms of Use will be governed by Massachusetts law, without reference to principles of conflicts of laws.
